Online advertising, analytics, and social media partners who help us measure campaign performance, build audiences, display user-tagged social content, or facilitate social sharing features.
When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.
Any information we obtain from third parties will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. How We Use Your Personal Information (and Legal Bases)
Depending on your jurisdiction, we process your personal information based on one or more of the following legal bases: (a) to perform a contract with you (such as fulfilling an order or administering the Terms of Service or official rules of a competition or event you entered); (b) our legitimate business, security, intellectual property protection, curatorial, and creative interests; (c) compliance with a legal obligation; or (d) your consent.

Administering Events, Photography Competitions, Social Features, and Creative Projects: When you voluntarily submit photographs, content, or registration details for a ROSA QUAY® event, competition, or project, share content featuring our Physical Premises or products on social media, or attend our physical venues ("Physical Premises"), we use this information (to perform our agreement/Terms of Service/event rules with you and for our legitimate curatorial and commercial interests) to review and judge entries, verify eligibility, communicate with participants, credit creators, curate physical and digital exhibitions, publish lookbooks, social media features, or editorials, and permanently maintain the ROSA QUAY® Brand Archive across our current and future projects.
Marketing, Advertising, and Audience Matching: We use your personal information for marketing and promotional purposes (based on our legitimate interests or your consent, where required by law), such as to send marketing, advertising, and promotional communications by email, text message, or postal mail, and to show you advertisements for products, events, or projects. This may include using your usage data or sharing pseudonymized/cryptographically hashed contact information with advertising platforms (such as Meta, Google, or TikTok) to create custom and "lookalike" audiences and better tailor the Services and advertising on our Site and other websites.
Premises Security, Anti-Counterfeiting, Fraud Prevention, and Legal Recourse: We use your personal information (including CCTV footage, IP logs, and order records) to ensure the physical security of our Physical Premises, prevent theft or unauthorized commercial photography/espionage, detect, investigate, or take action regarding possible fraudulent, illegal, infringing, or malicious activity (such as unauthorized web scraping or AI data harvesting), to prevent unauthorized chargebacks, and to establish, exercise, or defend legal claims (including seeking full indemnification or damages from users who breach our Terms of Service or submit infringing or misleading materials). If you choose to use the Services and register an account, you are solely responsible for keeping your account credentials safe.
Communicating with You and Service Improvement: We use your personal information and communication records to provide you with customer support, verify order or submission details, train our team, and improve our Services and user experience.
De-identified and Aggregated Data: We may de-identify or aggregate personal information so that it can no longer reasonably be used to identify you. All copyrights and other intellectual property rights in any photographs, video footage, or recordings taken by ROSA QUAY® or our authorized personnel within such premises shall belong exclusively to ROSA QUAY®. By entering such premises or attending our events, you irrevocably grant ROSA QUAY® and our affiliates and assignees the perpetual, worldwide, royalty-free right and license to use, reproduce, edit, exhibit, publish, and distribute your image, likeness, and voice captured therein for archival, editorial, curatorial, commercial, and promotional purposes across any media now known or hereafter devised, without further notice, approval, or compensation. If you do not agree to the foregoing, you should not and must not enter or remain within the event venues, rented premises, or physical stores. -

By submitting any registration data, personal information, or User Submissions (including photographs, artwork, or text) to ROSA QUAY®, you represent and warrant that: (a) all information provided by you is true, accurate, current, and not misleading; (b) you are the sole author and owner of the submitted content, or hold all necessary rights, licenses, consents, and explicit privacy/likeness releases (including copyright and portrait/likeness releases from any recognizable individuals depicted in your photographs) required to submit the content and grant ROSA QUAY® the rights described herein and in our Terms of Service; and (c) your submission does not infringe upon or violate the copyright, trademark, portrait rights, data protection/privacy rights, publicity rights, or any other legal or moral rights of any third party.
You expressly acknowledge and agree that ROSA QUAY® has neither the practical ability nor the legal obligation to pre-screen, investigate, or independently verify the authenticity, accuracy, or intellectual property/portrait/privacy rights clearance of each submission prior to its use, exhibition, or publication. -
Sole Responsibility, Indemnification & Right of Recourse:
The person submitting the information or content bears sole and complete legal responsibility (100% liability) for any issues, disputes, regulatory complaints, or claims arising from inaccurate, false, or misleading information, or from any infringement of third-party copyright, portrait rights, privacy/data protection rights, or other rights. If any breach of these warranties or any dispute relating to your submitted information or content causes ROSA QUAY®, our corporate affiliates, officers, creative collaborators, venue partners, or any third party to suffer any loss, damage, reputational harm, liability, fine, settlement, or expense (including full reasonable attorneys' fees and legal costs), you agree to fully indemnify, defend, and hold us and such third parties harmless, and ROSA QUAY® reserves the full right to retain your identifying records, disclose your identity to claimants/authorities where legally justified, and seek legal recourse and recover all such damages and losses directly from you.
We do not control who will have access to the information that you choose to make publicly available, and cannot ensure that parties who have access to such publicly displayed information will respect your privacy or keep it secure.
Cookies
Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies [1]. We use Cookies to power and improve our Site and our Services (including to remember your actions, cart contents, currency, and preferences) [1], to run analytics and understand user interaction with the Services (in our legitimate interests to administer, secure, improve and optimize the Services), and to permit third parties and service providers to tailor services, products, and advertising on our Site and other websites.
Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls [1]. Please keep in mind that removing or blocking Cookies can negatively impact your user experience [1] and may cause some of the Services, including certain features and general checkout functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.
Please note that because there is no consistent industry understanding of how to respond to "Do Not Track" (DNT) signals, we do not alter our data collection and usage practices when we detect such a signal from your browser. However, we recognize the Global Privacy Control (GPC) signal where required by applicable law, as detailed below.

We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, to resolve payment, customs, or chargeback disputes, to preserve our permanent brand and curatorial archives, to protect our intellectual property, to comply with legal and tax obligations, or to enforce our Terms of Service and other applicable contracts and policies (including pursuing legal claims or indemnification). However, these rights are not absolute, may apply only in certain circumstances, and, in certain cases, we may decline your request as permitted by law. Specifically, we may retain certain information despite a deletion or objection request where necessary to: (i) complete a transaction or protect against fraudulent, deceptive, infringing, or illegal activity (including resolving credit card chargeback disputes); (ii) comply with a legal, customs, or tax obligation; (iii) establish, exercise, or defend legal claims (including enforcing our intellectual property rights, Terms of Service, and indemnification and recourse rights); or (iv) exercise the right of freedom of expression and information, or maintain published curatorial, artistic, or archival records.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address, order number, or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide signed proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.
